The Indian government is set to introduce the Immigration and Foreigners Bill 2025 in Parliament, proposing stricter penalties for foreign nationals entering or residing in India without valid documentation. The bill aims to bolster national security by addressing illegal immigration.
Tougher Penalties for Illegal Entry
The proposed legislation outlines severe punishments for unauthorised entry into India. Foreign nationals without a valid passport or visa could face imprisonment of up to five years and a fine of ₹5 lakh. If the entry is facilitated using forged documents, the penalty could increase to seven years in prison and a ₹10 lakh fine.
Current laws impose a maximum of five years’ imprisonment and fines ranging from ₹10,000 to ₹50,000 for similar offences. The new bill seeks to significantly raise these penalties to deter illegal immigration.
Biometric Registration and Reporting Requirements
The bill mandates biometric registration for all foreign nationals. Those without valid documents will be required to leave India at their own expense. Additionally, educational institutions, hospitals, and homestays providing services to foreign nationals must report their details to designated registration offices.
Airlines and shipping companies will also be required to submit passenger information in advance. If an immigration officer denies entry, the traveller must be sent back immediately. Foreign tourists will not be allowed in restricted areas under the new rules.
Penalties for Overstaying and Other Violations
Foreign nationals overstaying their visas, violating visa conditions, or entering restricted areas could face up to three years in prison, a fine of up to ₹3 lakh, or both. Transporting foreign nationals without proper documentation could lead to a fine of ₹5 lakh. If unpaid, the vehicle used could be seized, impounded, or sold to recover the penalty.

External Affairs Minister S. Jaishankar has reiterated India’s firm stance against unauthorised immigration, supporting strict measures to prevent illegal entry. The bill aims to curb illegal immigration from neighbouring countries, reflecting the government’s commitment to national security.

Parliamentary Consideration
The bill is expected to be tabled in the upcoming parliamentary session. If passed, it will replace the existing Immigration (Carriers’ Liability) Act, 2000, and other outdated laws related to immigration and foreign nationals.
The government anticipates that these stringent measures will effectively address challenges posed by illegal immigration while safeguarding national security.
