Supreme Court Rejects Lalit Modi’s Plea for BCCI to Pay FEMA Penalty
The Supreme Court of India dismissed a petition by former IPL chairman Lalit Modi on Monday, seeking to compel the BCCI to pay a ₹10.65 crore penalty imposed on him by the Enforcement Directorate (ED). The fine, levied in May 2018, relates to alleged violations of the Foreign Exchange Management Act (FEMA) during the 2009 IPL season in South Africa, involving a ₹243.45 crore transfer to Cricket South Africa without RBI approval. Modi, BCCI vice-president from 2005 to 2010 and IPL chairman from 2007 to 2010, argued that BCCI’s bylaws required the board to indemnify him. The court, led by Justices P.S. Narasimha and R. Mahadevan, rejected the plea, deeming it “frivolous,” but allowed Modi to pursue the matter in a civil court. The Bombay High Court had previously dismissed a similar petition in December 2024, imposing a ₹1 lakh cost on Modi.
